Samsung Galaxy S3 Ban Will Not Happen in the U.S.
Apple was attempting to ban the sale of the upcoming Samsung Galaxy S3 smartphone in the U.S. and other parts of the world last week, and now the company seems to have hit a roadblock.
Reuters is reporting that Apple hoped to encourage Judge Lucy Koh to add the Galaxy S3 to existing preliminary injuction requests that the company had previously made on other Galaxy products.
However, Judge Koh stated that Apple's request would "overload her calendar" given a July 30 trial date for a previous Galaxy case that is already set.
Apple can still request to ban the smartphone with a separate hearing date, but the company will not be able to do it in enough time to block the Galaxy S3's launch at the end of this month.
Apple's next move is unclear, but the company will most make another attempt at blocking the sale of the Samsung device.
The situation stemmed from a patent infringement claim made by Apple last week against the Korean Electronic giant's latest smartphone.
The claim accused Samsung of violating patents held by Apple for its Siri voice-controlled assistant and other UI patents.
In the statement Samsung stated that it plans to "demonstrate to the court that the Galaxy S3 is innovative and distinctive." The company hopes to accomplish this before June 21, the day when the Galaxy S3 is scheduled to launch on most major U.S. carriers.
The patent infringement would ban the sale of the device in areas throughout the U.S., Australia and Europe.
Apple's current CEO Tim Cook recently met with the head of Samsung in a court session aimed at settling their ongoing smartphone war that Apple began last year.
The two companies are currently tangled in about 30 patent litigation suits in 10 different countries, according to The Wall Street Journal.
